Important news about McKesson Europe

31 October 2022 marked the conclusion of a deal with McKesson Corporation for PHOENIX group to acquire parts of McKesson Europe including Belgium, France, Ireland, Italy, Portugal and Slovenia as well as the European head office in Stuttgart, the shared service centre in Lithuania, Recucare GmbH in Germany and the minority stake in the joint venture Brocacef Groep in the Netherlands. The transaction will create an integrated healthcare provider that brings together more than 45,000 employees, covers 29 countries, includes 224 pharmaceutical wholesale and pre-wholesale sites, as well as more than 3,200 owned pharmacies and 17,000 partner pharmacies. Thanks to the combined expertise of both companies, all customer groups will benefit from additional products and services in accordance with their local needs.

2. Purpose and legal basis of data processing 

Video surveillance is carried out for the purpose of safeguarding domiciliary rights, for the purpose of deterring theft and vandalism, the investigation of theft and property damage and also the implementation of the necessary technical organisational measures concerning data security.

The legal basis is Art. 6 (1)(f) GDPR.

3. Legitimate interests pursued

Our legitimate interest is in the protection of our property, the avoidance or investigation of criminal offences, the enforcement, exercise or defence of legal claims, the control of unauthorised access, as well as the security of our premises.

4. Storage/deletion periods

The recordings are generally stored for a period of seven days and then automatically deleted. If an incident occurs, the recordings are stored for the duration of the investigation and prosecution of the incident or the exercise, enforcement or defence of any legal claims and is subsequently deleted.

5. Your rights

You have the following rights in relation to us, which you can assert in each case through the controller identified in Section 1:

  • Right of access: You are entitled to request confirmation from the data controller as to whether or not personal data concerning you is being processed at any time. If this is the case, within the limits of the statutory provisions, you can request information, free of charge and at any time, regarding any of your data processed by us, the purposes of processing, the storage period or the criteria for determining their storage period and recipients of the data. You are also entitled to obtain a copy of your data, Art. 15 GDPR.
  • Right to erasure: You have the right to obtain from the data controller the erasure of personal data concerning you without undue delay, insofar as one of the reasons provided in Art. 17 GDPR is met, e.g. if the data is no longer required for the legitimate purpose (right of erasure).
  • Right to restriction of processing: You have the right to obtain from the data controller restriction of processing where one of the conditions provided in Art. 18 GDPR applies, e.g. if the data subject has objected to processing, for the duration of the assessment by the data controller.
  • Right to object: You have the right at any time, for reasons arising from your particular situation, to object to the processing of data concerning you by us which is carried out on the basis of Art. 6 (1)(f) GDPR (legitimate interest of the data controller). In this event, we will no longer process the data concerning you, unless we can demonstrate compelling and legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves the assertion, exercise or defence of legal claims. (Art. 21 GDPR). Please send notification of objection to the address indicated in Section 1.
  • Right to lodge a complaint: Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority if you believe that the processing of your personal data infringes the GDPR (Art. 77 GDPR). You can assert this right with a supervisory authority in the Member State of your place of residence, your place of work or the place of the alleged infringement. You can lodge a complaint with the responsible state data protection authority.
